Aaron David "Cappy" Bernstein was born in Brooklyn, New York on 20 October 1926 and was appointed to West Point from the 13th Congressional District.

His West Point classmates recall: "From Beast Barracks to 'Recognition,' from Camp Buckner to Fort Bragg, from Camid back again to Beast Barracks, 'Cappy' never ceased to chase away the 'blues' with his happy smile and his clever line. 'Cappy' had a first name for everyone up to and including the chiefs of staff; here's hoping 'Mac' and 'Ike' will reserve all their future stars for 'Cappy.'"

During his cadet days Cappy was with the Railroad Club yearling, cow, and first class years; with the Art, Radio, and Spanish Clubs cow and first class years; with the Jewish Choir first class year; and was a Cadet Sergeant his first class year.

Upon graduation Cappy went in the Signal Corps and after attending the Signal Corps Training Center at Fort Gordon, Georgia reported to the 24th Signal Battalion from 1951 to 1952. His next assignment was to the 50th Signal Battalion in Korea from 1952 to 1953. In 1954 Cappy resigned his First Lieutenant's commission and pursued a career in the law. First, he obtained an LLB degree from Columbia University in 1957 then in 1960 became the Law Master for the Brooklyn Law School. In 1969 Cappy was appointed Secretary to the Superior Court Judge and in 1976 was appointed Judge of the New York City Civil Court. In 1981 Cappy became a Justice of the Supreme Court of New York, a position he continues to hold. Cappy and his wife Florence made their home in Brooklyn, New York.

The November 1997 Assembly noted "Cappy and Florence Bernstein report that he is finishing his 22nd year as a Justice of the Supreme Court, Kings County, NY, and she retired after 20 years teaching. Son Mark and daughter Ruth are practicing attorneys in New York while son Jamie is an interior designer. They have three granddaughters and one grandson."
